Mail Strikes Impact Bankruptcy Noticing Center Notices to Canadian Recipients

Monday, December 23, 2024

A mail strike by Canadian postal workers is adversely impacting delivery of bankruptcy notices that US Bankruptcy Courts mailed through the Bankruptcy Noticing Center (BNC) to Canadian recipients.  The strike ended on December 17, 2024, but Canadian recipients are not expected to receive such notices on schedule until after delays caused by the strike have been resolved.

The BNC issued paper notices between November 15 and December 10, 2024, but those were held at the Canadian/United States border during the strike.  Although mail service resumed on December 17, 2024, paper notices that were held at the border will take time to be processed and delivered.  Canada Post indicates that recipients should expect delivery delays through the remainder of 2024 and into January 2025.

Beginning December 10, 2024, the BNC began to bypass notice recipients if the last line of the address contained the word “Canada.”  No paper notice was mailed to bypassed recipients.  The BNC Certificate of Service indicates recipients who were bypassed as undeliverable.  The BNC resumed issuing paper notices to Canadian recipients on December 18, 2024.

Please note:  Electronic bankruptcy noticing (EBN) through the BNC is not an option for international recipients.
