Unclaimed Fund Distribution Instructions and Forms

Request Unclaimed Funds

Unclaimed funds are funds held by the court for an owner who is entitled to the money, but who failed to claim ownership of it or did not receive it. Most unclaimed funds arise when money is distributed by the trustee to creditors pursuant to a distribution order in a bankruptcy case, but goes unclaimed by the claimants (persons or entities who are entitled to the money). These funds are paid to the court until a claimant demonstrates ownership.

Claimants who want the court to distribute unclaimed funds must:

1. Complete the following forms

 2. Collect the required documents

Include the proof of identity (such as a copy of a photo ID or driver’s license), of the owner of record of the unclaimed funds.

Redact information on those documents as directed in Fed. R. Bankr. P. 9037, but include the full Social Security Number (SSN) or Taxpayer Identification Number (TIN) on AO213 Identification Form.

The documentation necessary to support an application may depend upon who is requesting the funds, such as:

Owners of Record: the persons shown in the court's records as the owner of the funds.

To verify the claimant's identity as owner of record, the claimant must provide to the court the following:

  • A notarized signature of the claimant;
  • The name, address and telephone number of the claimant;
  • The social security or tax identification number of the claimant; and
  • Any additional information that the court requires.

Successor Claimants: successor businesses, decedent's estates, assignees, judgment creditors, etc., who now have direct claims to the funds but are not the owners of record.

Successor Businesses: When a successor business claimant applies for release of unclaimed funds, the claimant must provide to the court the following:

  • Proof of identify of the owner of record;
  • A notarized power of attorney signed by an officer of the successor business;
  • A statement of the signing officer's authority; and
  • Documentation establishing chain of ownership from the original business claimant

Transferred Claims: When a successor claimant holding a transferred claim applies for release of unclaimed funds, the successor claimant must provide to the court the following:

  • Proof of identify of the owner of record;
  • Proof of identify of the successor claimant; and
  • Documentation evidencing the transfer of claim.

Decedent's Estate: When the owner of record is deceased and the decedent's estate (i.e., Administrator, Executor, Representative) applies for release of unclaimed funds, the decedent's estate must provide to the court the following:

  • Proof of identify of the owner of record;
  • Proof of personal identity of the estate administrator; and
  • Certified copies of probate documents establishing the representative's right to act on behalf of the decedent's estate.

Claimant Representatives: typically funds locators who act on behalf of owners of record/successor claimants.

When a representative of the owner of record or successor claimant applies for release of unclaimed funds, the representative must provide to the court the following:

  • Proof of identify of the owner of record, as detailed above;
  • A notarized, original power of attorney signed by the claimant on whose behalf the representative is acting;
  • Proof of identify of the representative; and
  • Documentation sufficient to establish the claimant's entitlement to the funds.

 

3. Submit the forms and the required documents

The Court will file the verified application and the judge will review the request and take appropriate action. Claimants may confirm that the application was received and check the status of their application by viewing the case docket using PACER (https://www.pacer.gov) or CM/ECF (https://ecf.ksb.uscourts.gov).

An unclaimed funds public search utility is located at https://ucf.uscourts.gov/.

To search for funds deposited with the U.S. Bankruptcy Court, District of Kansas, select KSB in the "Court" drop down box. Or leave the "Court" field blank to search all courts.  Populate other fields, as appropriate, to narrow your search.

The unclaimed funds public search utility may also be used to search unclaimed funds records maintained in other bankruptcy courts by selecting the court name abbreviation in the drop down box. Each court maintains its own unclaimed funds records. Please contact individual bankruptcy courts for information regarding the status of and/or application procedures for release of unclaimed funds listed for that court.
