OVERVIEW

 

This event, used ONLY by the case trustee of record, is used to indicate the outcome of the section 341 meeting of creditors.

 

 

PROCEDURE

 

        1. Select Bankruptcy

        2. Select Trustee's 341 Filings

        3. Enter Date of the 341 Meeting and click Next

        1. For each case listed select one of the following four options (screen example)

          • No Action-This case will appear on this list again if this option is checked. No processing will be done to this case.

          • Trustee’s Report of No Distribution - This refers to any case where the trustee has confirmed there are no assets.   The resulting docket entry will also note Meeting of Creditors Held and Concluded.

Trustee's Report Of No Distribution And Notice Of Intended Abandonment. The trustee has performed the duties required under 11 U.S.C. 704 and there are no assets to administer for the benefit of creditors. The trustee received no funds or property of the estate, and paid no monies on account of the estate. Any non-exempt real or personal property listed by the debtor(s) has no realizable value to the estate and is burdensome. Therefore such non-exempt property shall be deemed abandoned pursuant to order of the Court and 11 U.S.C. 554(c). Pursuant to Fed. R. Bankr. P. 5009, the trustee certifies that the estate of the debtor has been fully administered, and prays that this report be approved and the trustee be discharged from office.           • Trustee’s Initial Report - This refers to cases where the 341 meeting has been held and concluded and the trustee does not want a Report of No Distribution filed (i.e., an asset case, or still investigating assets in a Chapter 7 case).

          • §341 Meeting Continued - This is an opportunity for the user to reset the meeting date and time. When this option is selected, the previous meeting will be satisfied and a new date for the continued meeting will appear on the calendar and be docketed to the case.
