Motion for Relief from Stay     Modified 03/01/2004

 

OVERVIEW

 

The following procedure is for filing a Motion for Relief from Stay.  Most of the Motions/Applications follow the procedure outlined below.  The Certificate of Service should be included in the body of the motion thus eliminating the need to docket a separate entry for Certificate of Service.

WARNING: This event should NOT be used for Relief from Co-Debtor Stay pursuant to 11 U.S.C. Sec. 1201 or 11 U.S.C. Sec. 1301.  Instead, use the Relief from Co-Debtor Stay event.

 

PROCEDURE

 

        1. Select Bankruptcy

        2. Select Motions/Applications

        3. Enter case number and click Next

        4. Verify correct case number and caption

        5. Select Relief from Stay

 

NOTE: For Multi-part motions highlight the first motion and then press and hold the Ctrl key and select the second motion.  Release the control key after the selections have been made.  Proceed with the steps outlined below.

 

        1. Indicate if this is a joint filing with another attorney(s)

        2. Select Additional attorneys if appropriate

        3. Select or Add/Create Party

          • The Party Attorney Association screen may display.  Indicate the party you represent.

        4. Browse, verify and attach the Motion/Application (pdf file)  

          • Attach supporting documents, if applicable.

        5. Is the motion a request for court approval of a stipulated agreement (y/n)? Specify and click Next.

        6. If No above, Make sure the Receipt number field is blank for credit card payments and click Next.

        1. Modify docket text as appropriate

 

WARNING: Verify filing entry information is correct before submitting the Final Docket Text.

 

        1. Save the Notice of Electronic Filing.
