OVERVIEW

 

If appellant elects to have the appeal heard in District Court pursuant to 28 U.S.C. Sec.158(c)(1), that fact must be stated clearly in a separate pleading which must be filed with the Notice of Appeal.  

 

 

PROCEDURE

 

        1. Select Bankruptcy

        2. Select Appeal

        3. Enter case number and click Next

        4. Verify correct case number and caption

        5. Select Election to USDC

        1. Indicate if this is a joint filing with another attorney(s)

        2. Select Additional attorneys if appropriate

        1. Select Party or Add/Create Party

          • The Party Attorney Association screen may display.  Indicate the party you represent.

        1. Browse, verify and attach the Election (pdf file)  

          • Attach supporting documents, if applicable.

        2. Select the appropriate event to which your event relates (normally the previously filed Notice of Appeal) and click Next

        1. Is the Certificate of Service executed and attached (y/n)?  Specify and click Next

        2. If yes, Enter the Certificate of Service Date and click Next

        3. Modify docket text as appropriate

 

WARNING: Verify filing entry information is correct before submitting the Final Docket Text.

 

        1. Save the Notice of Electronic Filing.
