Motion for Adequate Protection     Modified 03/11/2004

 

OVERVIEW

 

A Motion for Adequate Protection is generally filed by a secured creditor who is concerned about the collateral and is seeking either monetary relief (in the form of a cash payment for the debtor's continued use of the collateral) or some other relief (such as proof of car insurance).

 

Note

A motion for adequate protection is usually filed with a Motion for Relief and styled “Motion for Relief from Stay, or in the Alternative, Motion for Adequate Protection”, which requires a $150 fee.  If this is the case, file the document using the Relief from Stay event code and also select Motion for Adequate Protection, by pressing the Crtl key while clicking.

 

 

PROCEDURE

 

        1. Select Bankruptcy

        2. Select Motions/Applications

        3. Enter case number and click Next

        4. Verify correct case number and caption

        5. Select Adequate Protection

        1. Indicate if this is a joint filing with another attorney(s)

        2. Select Additional attorneys if appropriate

        3. Select or Add/Create Party

          • The Party Attorney Association screen may display.  Indicate the party you represent.

        4. Browse, verify and attach the Motion/Application (pdf file)  

          • Attach supporting documents, if applicable.

        5. Modify docket text as appropriate

 

WARNING: Verify filing entry information is correct before submitting the Final Docket Text.

 

        1. Save the Notice of Electronic Filing.
